These Terms of Use are the agreement between Esviralabs and the person who downloads, installs and uses the Koamoli mobile application.
Because Koamoli is made for young children, these Terms are addressed to the adult responsible for the device. By downloading, installing or using the app, you accept them.
If you do not accept them, do not use the app.
How information is handled is explained in the Koamoli Privacy Policy; we suggest reading the two documents together.
These Terms are a binding agreement governing your access to and use of the Koamoli mobile application, the content inside it, the Koamoli Plus subscription and the support we provide by email (together, the “Services”).
A child may use the app, but the agreement is with the adult who downloads it and controls the device.
If you obtained the app from the App Store, Apple's Licensed Application End User License Agreement also applies. Where these Terms conflict with it, Apple's agreement prevails to the extent of that conflict.

In these Terms, “Koamoli”, “we”, “us” and “our” mean Kürşat Şen Kitapify operating under the Esviralabs brand. Koamoli is not a separate legal entity.
Koamoli is designed for children roughly aged 3 to 7, to be used with an adult involved.
You must be an adult and legally able to enter into this agreement in order to download the app, accept these Terms or make a purchase.
You decide whether the app is suitable for your child. The age range is guidance, not an assessment or a developmental benchmark.
As the parent or guardian, you are responsible for:
Do not enter information you would not want stored on the device. A first name or nickname is enough: no surname, address, school or health information is needed, and the app does not ask for any.
Screens meant for adults — purchases, settings that change how the app behaves, and any link that leaves the app — sit behind a parental gate.
The gate is a simple check designed to be difficult for a young child and easy for an adult.
The parental gate is not:
It will not stop an older child or an adult who wants to get past it. Keeping the device's own screen-time and purchase restrictions in place matters at least as much.
Koamoli includes mealtime sessions with Moli, early-learning activities, Stars and rewards, the Closet, the Garden and the Food Explorer.
All audio in the app is recorded audio that ships with it.
Features may be added, changed or removed as the app develops. We do not promise that any particular feature will be offered indefinitely.
There is no account inside the app beyond the child profile stored on the device, and a child cannot communicate with anyone through the app.
Some content and features are part of Koamoli Plus, an optional subscription.
What is included in Koamoli Plus is shown inside the app before you buy, on a screen behind the parental gate.
The subscription is sold through the App Store. Prices are set per country by the store, and the price shown in the App Store at the moment of purchase is the price that applies. We state no price on this page.
A subscription is personal and granted for use in your household. It cannot be transferred or resold.
Koamoli Plus is an auto-renewing subscription.
It renews automatically unless it is cancelled at least 24 hours before the end of the current period, in line with the App Store's subscription rules.
Your store account is charged for the renewal within the 24 hours before the current period ends, at the price shown for the next period.
Renewals are managed by Apple through the subscription settings of your store account, not by us.
Apple's notice and consent rules apply to any price change.
If a free trial or an introductory offer is shown at the time of purchase, its length and terms are the ones displayed on that screen and in the App Store.
A free trial or introductory offer is not guaranteed. It may not be available in every country, and it may not be available to a store account that has already used one.
Unless a trial is cancelled before it ends, it converts into a paid subscription under Apple's rules.
Where the store applies that rule, any unused part of a free trial ends when a subscription is purchased.
Billing is handled by Apple through the store account used on the device.
Koamoli does not receive, see or store card numbers, billing addresses or payment details. We do not claim to process card details ourselves.
Taxes and currency conversion are applied by the store.
If a payment fails, Apple decides how and when to retry it and when access ends.
You can cancel at any time from the subscription settings of your store account.

Cancelling stops the next renewal. It does not shorten a period you have already paid for; access normally continues to the end of that period.
Deleting the app does not cancel a subscription.
Nor does asking us to cancel it: only the store account holder can cancel an Apple subscription, through Apple's subscription settings. We cannot take that step on your behalf.
Because the purchase is made from Apple, refunds are handled by Apple under Apple's policies.
We cannot issue, promise or refuse a refund on Apple's behalf.
If you believe you have been charged in error, request a refund through Apple's own process.
Where mandatory consumer law in your country gives you a further right — for example a statutory right of withdrawal — that right applies regardless of this section. You are also welcome to write to us and we will help where we can.
If you reinstall Koamoli, or set up a new device with the same store account, you can bring back an active and eligible subscription using “Restore Purchases” in the app.
Restoring works through the store account that made the purchase. A subscription bought on a different account cannot be restored onto yours.
Restoring does not bring back the child profile data stored on the device. That data belongs to the device, and we hold no copy of it.
Koamoli keeps the child's profile and progress on the device. We hold no copy.
Uninstalling the app removes its local data according to the platform's own behaviour. We cannot recover it for you.
If you want to preserve it, keep the device's own backup settings in place.

Koamoli is not a medical device, a health product or a nutrition service.
The app does not diagnose, treat or manage any condition, including feeding difficulties, selective or “picky” eating, allergies, intolerances or eating disorders.
Nothing in the app is medical, dietetic, psychological or nutritional advice, and none of it is a substitute for advice from a qualified professional.
We make no claim that using Koamoli will cause a child to eat more, to eat differently, or to reach any nutritional outcome. No such outcome is promised.
Decisions about what and how much your child eats — including anything involving allergies — are yours, together with your healthcare professional. Judging whether the app's content suits your child is also yours.
If you have a concern about your child's eating, growth or health, speak to a doctor or a registered dietitian.
Koamoli's purpose is to support a calmer, parent-guided mealtime routine and playful learning around food.
The learning activities in Koamoli are general early-childhood play.
They are not a curriculum, an assessment tool or a programme that replaces schooling.
We do not promise any particular educational result, attainment or rate of progress. Children learn at different rates.
Progress shown in the app reflects activity inside the app and nothing more.
In using the app, you agree not to:
We may end your right to use the app if these Terms are materially breached.
The Koamoli name, the character Moli, and the app's artwork, audio, text, design and code are owned by Kürşat Şen Kitapify, operating under the Esviralabs brand, or licensed to us.
Downloading the app or buying a subscription gives you a personal, non-transferable, revocable licence to use it on devices you control, for your household, for as long as these Terms are respected.
Nothing is sold to you, and no right beyond that licence is granted.
Apple's and other third parties' trade marks belong to their respective owners.
Koamoli is provided as it is at the time you use it.
We may update the app, change features, or stop offering the app or any particular feature.
Compatibility depends on the device and the operating system version, and support for older systems may end.
If the subscription service is discontinued while a period you have paid for is running, that will be handled in line with the store's rules and applicable law.
We do not promise uninterrupted or error-free operation.
Koamoli relies on Apple for distribution and payments, and on RevenueCat to manage subscription entitlements.
Your use of the App Store is governed by Apple's own terms. We are not responsible for the availability of these services or for their own practices.
What these providers process for Koamoli is explained in the Privacy Policy.
Apple is not a party to these Terms and is not responsible for the app. As Apple requires, Apple and its subsidiaries are third-party beneficiaries of these Terms and have the right to enforce them against you.
If Koamoli is later published on another store, the sections about purchases will be updated for that store.
To the maximum extent permitted by applicable law, the Services are provided “as is” and “as available”.
We give no warranties of any kind, express or implied, including fitness for a particular purpose, merchantability and non-infringement.
We do not warrant that the app will run without interruption, without error, or identically on every device.
This section does not affect mandatory consumer rights that cannot be limited by contract.
To the maximum extent permitted by applicable law, we are not liable for indirect, incidental, special or punitive damages, or for loss of profit, data or reputation.
In any event, our total liability is limited to the amount you paid for Koamoli Plus in the twelve months before the event giving rise to the liability.
Nothing limits or excludes liability for death or personal injury caused by negligence, for fraud, or for any other liability that cannot be limited under applicable law.
Your mandatory rights as a consumer are unaffected.
These Terms are governed by the laws of the Republic of Türkiye.
If you are a consumer resident elsewhere, this does not deprive you of the protection of mandatory consumer-law provisions of the country where you live.
We would rather resolve a problem by email first: write to support@esviralabs.com.
If an amicable resolution is not reached, disputes will be heard by the courts and enforcement offices of İstanbul, Türkiye, unless mandatory law provides otherwise.
Where mandatory law gives you the right to bring proceedings where you live, that right is unaffected.
Consumers in Türkiye may also apply to the consumer arbitration committees and consumer courts within the applicable monetary limits.
We may update these Terms as the app or the law changes. The date at the top of this page shows when the text last changed.
Continuing to use Koamoli after a change means the updated Terms apply.
If a change materially affects a subscription you already hold, we will make that clear.
